Reservations
Vacation Rentals in Paradise, LLC, (the Agent) acting for and representing the Owner of the property, reserves the right to substitute a reserved room for another room that is of equal or greater value, at its discretion. In the event that rented premises becomes uninhabitable prior to a Guest rental period, or in the event of an error in reservation procedure or change in the ownership which precludes occupancy by Guest, Agent reserves the right to take corrective action without loss to Agent. Liability to Agent/Owner is limited to monies paid by Guest. Notification of such corrective action will be provided to Guest at the earliest possible time. CONSTRUCTION: If condo under construction is unfinished at the time of occupancy date, the Agent/Owner liability is limited to full refund of rent payments and a good faith effort by Agent to located replacement accommodations. Guest waives any and all other claims against Owner or Agent for non-completion of the property under construction. FORECLOSURE: If Agent becomes aware of any foreclosure proceedings, Agent will notify Guest at the earliest possible time. In the event of a monetary loss to Guest, Guest understands that their sole recourse is with the Owner of the property. Guest agrees that Agent cannot be held responsible for funds lost due to a voluntary or involuntary transfer of property ownership.
 
Charges
Guest agrees to the total amount of their reservation as outlined at the time of booking. Guest agrees to pay the remaining balance of their reservation 30 days prior to the date of check-in. Guest agrees to be held liable for the full amount of their reservation and agrees to be held both personally and financially responsible. 
 
Damages
Any damages to property, building, condo or any of its contents could result in charges up to $2,000.00. Guest will be notified in writing and Guest agrees that charges can be processed on Guest’s credit card or Guest agrees to send payment for damages within 10 (ten) days of notification. 
 
Check-In / Check-Out
Check-in begins at 4:00 PM. If the rented property is not available for an earlier check-in, Guest may relax at the pool or enjoy the beach while the unit is being prepared. During prime season, spring break and other high-demand times, check-in may be extended after 4:00 PM. Guest must be at least 25 years of age to check-in. Government-issued identification may be required at check-in.

Check-out is prior to 10:00 AM.  Agent will make every effort to accommodate a pre-arranged late check-out request, when possible.  If a late check-out is granted, a late check-out fee may apply, not to exceed the cost of one additional nights stay. 
 
Cancellation Policy
Reservations canceled more than 60 days prior to check-in will receive a refund of the deposit amount, less a $100 cancellation fee. Refunds are issued via check, through the mail. Reservations canceled 30 to 60 days prior to check-in will forfeit the full amount of the deposit. Guest will remain responsible for the full amount of the reservation total should a cancellation occur within 30 days of check-in.

Payments
A 20% deposit is required, along with guest contact information, to confirm a reservation. If a reservation is booked within 30 days prior to check-in, the full amount of the reservation is due upon booking.  The deposit is applied towards the total of the reservation and the remaining balance is due 30 days prior to check-in. Reservations with unpaid balances within 30 days of check-in may be subject to cancellation without refund. Unless advised otherwise, Agent may use the initial form of payment for auto billing of final payment within the due date period. 

Payments must be made in the form of US dollars.  Checks should be made payable to Vacation Rentals in Paradise.  Agent accepts payments with Zelle®. Agent also accepts AmericanExpress, Discover, MasterCard and Visa. A 4% surcharge is applied to all credit/debit card transactions. 

Guest is responsible for paying the full amount of any returned check in addition to a mandatory returned check fee in the amount of $40 for a check written in the amount of $800 or less; 5% of the returned check fee for checks written in excess of $800.   Payment must be received within 10 business days of being notified of a returned check or the reservation will be cancelled and/or Guest evicted.

Accommodations Capacity
We strictly follow the state law guidelines of maximum number of persons per condo. A maximum of 6 persons is allowed in a 2 bedroom condo and a maximum of 4 persons in a 1 bedroom condo.  Failure to disclose the correct number of occupants in the condo will result in immediate eviction of the entire part and forfeiture of all payments.
 
Parking
Each property has one (1) designated parking spot per guest reservation. Every vehicle parked on the property must display the parking pass provided at check-in. Additional parking for a second vehicle is on a first come, first served basis and is not guaranteed.

Town of Fort Myers Beach Code of Conduct
Guest agrees that they are aware of and intend to comply with the Town of Fort Myers Beach Code of Conduct, which can be found by visiting www.fortmyersbeachfl.gov
 
Hurricane/Tropical Storm Cancellation Policy
In the event of a Tropical Storm/Hurricane, no refunds will be issued unless State/Local authorities order mandatory evacuations for the Fort Myers Beach area. Should an evacuation be ordered, we will refund: a) Any unused portion of rent from a guest currently staying at an Agent managed property that Vacation Rentals in Paradise, LLC has collected or b) The 20% deposit for a reservation that is scheduled to arrive during the tropical storm/hurricane evacuation period.  These refunds will be made by check through the mail, after the storm/hurricane passes.  Agent is not responsible for: a) Finding alternate lodging and b) Financial losses related to transportation or alternate lodging. Any Guest wanting to check-out or cancel their reservation due to mere bad weather will not receive a refund of any kind.

Non-Smoking & Non-Vaping Policy
Bay to Beach is a completely smoke and vape free facility. Smoking and/or vaping is strictly prohibited in/on any area of the property.  This includes condo units, lanais, pool and parking areas, beach, hallways, stairwells, atrium, etc.  Any Guest who violates this policy may be charged a minimum of $500 and Guest(s) may be asked to leave the property. In this event, rental payments are not refundable.

Pet-Free
Properties are personal residences and are completely pet-free.  Pets are not allowed on the property, in the condos, common areas, pool area, private beach area and/or parking areas.  Any Guest who violates this policy will be evicted immediately and forfeit their rental payment.  Additional charges of $500 will be charged to clean the condo.

Turtle Season - (May 1 through October 31)
Fort Myers Beach is an environmentally sensitive barrier island with a protected population of Sea Turtles who visit the beach each year to lay eggs. To protect the nests and aid in the future generations of Sea Turtles, Lee County has a Sea Turtle Conservation Code, which is strictly enforced and includes $5,000.00 fines for turtle disorientation. Guests agree to adhere to the following:
    • Shut off or shield lights that are visible from the beach
    • Close curtains or blinds after dark
    • Do not use flashlights, lanterns, cellphones, or any other non-approved light source on the beach after dark
    • Fires are not permitted on Fort Myers Beach at any time
    • Fill in any holes dug in the sand and remove all beach furniture, umbrellas, towels, boats, toys, tents, etc. by 9:00 PM every night and store them close to the building or landward of dune vegetation
Leave turtle nest sites undisturbed. If you find a hatchling wandering in daylight, place moist sand in a dry container, shade it and call Turtle Times, Inc. immediately: 239-481-5566.

The Guest has read and agrees to abide by the terms, rules and regulations set forth by signing below, making payment or occupying the premises, and accepts this Agreement in its entirety.
